Customer Service Terms and Conditions
1) Accounts
a) In order to have access to all operative parts of the Site, and to purchase goods or vouchers via the Site, you must first create an account on the Site. When creating an account, you will be asked to provide an email address and your geographic location.
b) By creating an account, you consent to Mrandmrspose sending you information and email communications relating to special offers and important administrative information regarding the Site.
c) Mrandmrspose reserves the right to refuse registration of an account (or to close an existing account) where:
i) you have opened, or are attempting to open, an account in a fraudulent or illegal manner;
ii) you have an existing account;
iii) It is compelled to do so by any applicable law or court order; or
iv) you have breached the Terms;
d) You are solely responsible for the activity that occurs on your account and for keeping your account details secure and up to date.
2) Purchasing
a) By making an order to purchase, you warrant to Mrandmrspose that you are:
i) eighteen (18) years of age or above; and
ii) entering into a legally binding contract with Mrandmrspose with respect to that purchase.
3) Placing Orders
a) Mrandmrspose provides account-holders with opportunities to purchase Goods or gift vouchers.
b) You can place an order with us online as follows:
i) Browse the site and add an item to your cart by clicking the item to view the product detail page, selecting your size and clicking the ‘Add to Cart’ button.
ii) The numbers of items in your cart, the total cart value and a link to ‘View Cart’ appear in the rop right corner of your page.
iii) To checkout, click the My Cart or View Cart links in the top right corner of your page. Review the items and quantities in your cart, select a shipping option, enter your postcode and click the ‘Check Out’ button.
iv) Complete the details on the Check Out page, noting the total amount payable at the bottom. Select your payment method and submit for secure payment gateway processing.
c) By placing an order on the Site, you are making an offer and commitment to purchase goods or a gift voucher on the Terms.
d) Mrandmrspose reserves the right to accept or reject your offer to purchase for any reason. In the event Mrandmrspose cancels your order to purchase a Voucher, Mrandmrspose will charge-back the full purchase price to your credit card.
e) Once you have made an order to purchase on the Website, you cannot cancel that order.
4) Issue of Goods or vouchers
a) Once you have placed your order, you will be prompted to enter your credit card information or Paypal for payment purposes.
b) Once you have entered and confirmed your credit card details, you will have bought your item. You will then receive a confirmation of your order (whether by email or via your Account) and your credit card will be charged for the purchase price.
c) You will only be issued with the goods or a gift voucher if full payment has been received by Mrandmrspose.
d) Mrandmrspose is not liable or responsible for any loss suffered as a result of a emails not being received by you (including, without limitation, due to an email being blocked by a firewall or filter or where you have registered an incorrect email address).
5) Payment Methods
a) We accept Paypal accounts or Visa and Mastercard credit cards through the Paypal payment gateway even if you do not have a Paypal account.
b) Select Paypal as your payment method, click submit and you will find links to login to your Paypal account or pay without a Paypal account on the next page.
6) Shipping & Delivery
a) We are currently shipping to Australia and New Zealand.
b) Our distribution agreements may limit our ability to ship to other countries however, please contact us if you have any questions and we will happily help or refer you to someone who can help in your region.
c) Orders are usually packed in one to two business days. We offer domestic and international shipping via Australia Post and DHL with delivery estimates of 3-5 days depending on your location. Shipping fees, duties, taxes and brokerage fees are paid when you place your order. We do not refund shipping and do not reimburse returns shipping.
7) Important notes regarding shipping:
a) Shipments are subject to customs clearance procedures which can cause delays beyond original delivery estimates.
b) A business day is considered to be Monday through Friday, excluding holidays.
c) Duty and taxes are set by the destination country. The amount of applicable duty and taxes will vary by country and will be determined during Checkout.
d) Shipping costs may include the following charges:
i) Freight – Transportation costs incurred by the Carrier
ii) Fuel – Additional charge incurred by the Carrier to account for an increase in fuel charges (% of freight)
iii) Insurance – Accounts for insuring the package
iv) Duties – The amount charged by the country for an individual item
v) Taxes – The Sales, Value Added Tax (VAT) or Goods and Services Tax (GST) charged by the country
vi) Brokerage – The amount charged by the Broker to clear customs
vii) Disbursement – The amount the Carrier charges to disburse the costs to the country
viii) Other Fee(s) – The transaction fee and any additional costs that may incur (i.e. rural area charges, extra fees for a particular country, etc.)
8) Viewing Orders and Updating Account Information
a) You can edit your user information, view orders and raise and view support cases in the My Account secure zone after you have logged in using the links at the top right of every page.
9) Returns & Replacements
a) We hope you're happy with your purchase but in the event you need to return an item, returns are accepted on merchandise that is in original, unused condition (including all packaging and tags) within 21 days from the date of purchase. Shipping charges are not refundable and we do not cover return shipping. Please allow adequate time for shipping to ensure the return is received within 21 days.

10) Your Conduct
a) Although Mrandmrspose welcomes and encourage user interaction on the Site, we insist and require that you restrict any and all activity in connection with the use of the Site to that which involves lawful purposes only.
b) You must not post or transmit through the Site any material which violates or infringes in any way upon the rights of others, or any material which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law.
c) You shall not use the Site to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of users of the Site to become users of other on- or offline services directly or indirectly competitive or potentially competitive with Mrandmrspose.
11) Copyright and Trademarks
a) Everything located on or in the Site is the exclusive property of Mrandmrspose Pty Limited or used with express permission of the copyright and/or trademark owner.
b) Any copying, distributing, transmitting, posting, linking, deep linking, or otherwise modifying of the Site or any of the Microsites without the express written permission of Mrandmrspose Pty Limited is strictly prohibited.
c) Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and / or criminal penalties. You may download, print and/or save copyrighted material for your personal use only.
12) Limitation of Liability
a) Subject to claims available under applicable consumer protection laws, neither Mrandmrspose nor its related bodies corporate is liable:
i) to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including any form of consequential loss such as any third party loss, loss of profits, loss of revenue, loss of opportunity, loss of anticipated savings, pure economic loss and any increased operating cost) however caused and which is suffered directly or indirectly in connection with your use of the Site;
ii) for disruptions to the Site; and
iii) to you or anyone else if interference with or damage to your computer systems occurs in connection with use of this Website or an external website. You must take your own precautions to ensure that whatever you select for use from this Website is free of viruses or anything else that may interfere with or damage the operation of your computer systems.
b) For claims that cannot be excluded or restricted under consumer protection laws , the liability of Mrandmrspose for such a claim will (to the extent permitted by law) be limited to:
i) in the case of goods:
(1) repairing or replacing those goods; or
(2) paying the cost of having those goods repaired or replaced; and
ii) if the breach relates to services:
(1) resupplying those or equivalent services; or
(2) paying the cost of having those services resupplied.
c) Mrandmrspose will not be liable for any delay in fulfilling its material obligations under the Terms if such delay is due to an act of God, act of terrorism, revolution, civil strife, industrial action, fire, flood, war, public disaster, plague or epidemic, delay in transportation or other cause, event or circumstance outside Mrandmrspose's control which is not due to any lack of reasonable prudence or foresight.
13) Indemnity
You will at all times indemnify, and keep indemnified, Mrandmrspose and its directors, officers, employees, agents and related bodies corporate from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by Mrandmrspose arising from any claim, demand, suit, action or proceeding by any person against you or Mrandmrspose where such loss or liability arose out of, in connection with or in respect of your use of the Site, your conduct and/or your breach of the terms.

15) General
a) By using the Site, you agree to be bound by the Terms. If you do not agree to the Terms, please refrain from using the Site.
b) Mrandmrspose reserves the right to make any changes to the Terms as it deems necessary or desirable without prior notification to you. We suggest to you, therefore, that you re-read the Terms from time to time in order that you stay informed as to any such changes.
c) If we make changes to the Terms you continue to use the Site, you will be deemed to have read, understood and agreed to be bound by the updated Terms.
d) Any provision of the Terms which is held to be illegal, void or unenforceable shall be deemed to be severed and the remainder of the Terms read in full force and effect.
Mrandmrspose's failure to enforce any provision of the Terms will not be considered a waiver of its right to enforce such provision. The Terms are to be interpreted in accordance with the laws of New South Wales. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, and waive any right to claim that those courts are an inconvenient forum.
